William J. Renahan Date, Arbitrator in the the matter between Sushil Dhir and Non-Marine Underwriters, Members of Lloyd's found that Dr. Grossman a designated assessor for disability under the guidelines of the Ontario Insurance Commission at one of Ontario's Designated Assessment Centres took on the role of advocate for the Insurer.
In a letter to the Insurer's adjuster, Dr. Grossman wrote that he was trying to write his report "so as to be of maximal benefit when he takes you to mediation/arbitration."
The hearing was held at the offices of the Ontario Insurance Commission in North York, Ontario, on April 6 and 7, 1998.
It is rumoured that Dr. Grossman's brother is also an advocate for the insurance industry acting as a lawyer for some major insurance companies, possibly a family tradition of insurance industry advocacy.
The tolerance of the OIC for this type of behaviour raises the question of whether this is one isolated incident or the tip of an iceburge of bias towards the insurance industry under Ontario's system of no fault insurance.
